TERMS OF SERVICE
Digital Files ( Music, Soundtracks, Images, Sheet Music) and Physical Files / Objects provided to the client by me, the creator, fall under the following terms:
Project, Commission, Track, Content
BASICS
- I accept the following payment methods:
Cash App, Venmo, Zelle, Wize, PayPal
- I have the right to showcase any and all content on this portfolio
If there is a group project or contract involved, content will not be posted without the owner(s) permission
- When assigning me a task, please make sure to provide a clear theme and/or reference
Failure to do so may result in an unsatisfactory result. There will be multiple opportunities
to inform me of anything you are not satisfied with
- Everything in this portfolio was made by me. You are not allowed to use anything in this portfolio (currently available or removed tracks) outside of the discussed agreement and/or for listening purposes
COPYRIGHT
- I, the creator, retain exclusive rights to original tracks and sound effects (also known as content)
The client may not claim any content as solely theirs
- Credit must be given to me, the creator
- Content cannot be used outside of its agreement
PROHIBITED ACTIONS
- You are not allowed to alter content made for you in any way, any shape, or any form without my permission
Do not hesitate to contact me if there are any misunderstandings
- Do not use my content for AI Training or anything outside of its intended usage
- Do not remix any of my solo songs ("TLU" or Albums made by XONO DAVIS) unless you are permitted to
REFUNDS
- If I or the client cancels the project before work has been started, a full refund ( 100% ) will be given
- If the project is canceled as it is actively being worked on either by I or the client, then the amount that will be refunded will depend on how much progress has been made:
PLAN OUT
this is typically a piano melody for rhythm and melodic testing

- If there is no communication from the client ( Also known as going "MIA" ), then I will have to cancel the commission, and no refunds will be given
This will be considered Client Cancellation
- I have the right to re-purpose projects cancelled by the client for any future projects.
- If the project is canceled due to my inability to complete it, then a full refund will be given
I have the right to cancel any commission at any time without reason or explanation
WORKFLOW
- I work best when given a clear and concise theme and/or example with the ability for added freedom and customization
- There may be delays or problems on my part. If there are any, I will be sure to inform you of them
- Poor contact will lead to cancellation
Before hiring me, please make sure that you are legally allowed to hire others for work, send money, and are allowed to work in your country of residence
For Group Projects (e.g., production teams), payment, workflow, and showcasing will vary depending on each team's specific requirements, rules, assets, and budget. Please make sure to communicate/have documentation to ensure that there isn't any miscommunication
You automatically agree with these terms by hiring me, commissioning, or adding me to a project with the intent of having me (Xono) produce/compose music and or "content".
Failure to agree to these terms will result in legal action and/or cancelation: blacklisting
If my TOS is updated as I am working on a commission, I will inform you to
prevent any confusion.
Changes to prices will not apply to those who have hired me before the TOS update
